Terms & Conditions - Coaching Services.

Description of Coaching: Coaching is partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.

1) Coach-Client Relationship

A. Coach agrees to maintain the ethics and standards of behavior established by the International Coach Federation “(ICF)” (Coachfederation.org/ethics). It is recommended that the Client review the ICF Code of Ethics and the applicable standards of behavior.

B. Client is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands that coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

C. Client further acknowledges that he/she may terminate or discontinue the coaching relationship at any time in written notice with a three week notice period.

D. Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility.

E. Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the Diagnostic and Statistical Manual of Mental Disorders (DSM) and also not as defined by the American Psychiatric Association or any other related associations. and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.

F. The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.

2) Services

The parties agree to engage in a Coaching Program through face-to-face or online meetings. Coach will be available to Client by e-mail and Whatsapp in between scheduled meetings as defined by the Coach with a 48 hour response time during working days only (on Mondays, Tuesdays, Thursdays and Fridays from 9am - 5pm Amsterdam/CE(S)T time). Coach may also be available for additional time, per Client’s request on a prorated basis hourly rate of €250,- excl. VAT (for example, reviewing documents, reading or writing reports, engaging in other Client related services outside of coaching hours).

3) Schedule and Fees

This coaching agreement is valid as of the date on the Coaching Agreement. The fee is as mentioned in the Coaching Agreement. 

Part of the fee is paid in advance and due before the start of the coaching sessions or other services if not stated differently in the Coaching Agreement. Please make payments to A.C. Bleijenberg Nauerz, Your Next Chapter, bank account IBAN no. NL30 ABNA 0247 8852 66 BIC: ABNANL2A of ABN AMRO bank in the Netherlands. Address: Bernhard Eilershof 5, 1087DC, Amsterdam, The Netherlands. Payment is due 14 days from the invoice date.

Or use any available payment link received by email to fulfill the payment by credit card or other preferred payment method before the start of the program/service.

Your Next Chapter does not offer any refunds for services that have already been delivered.

A) Fees for missed coaching sessions 

Your Next Chapter offers a 24-hour reschedule window for coaching services (this does not apply to other services). Meaning within a 24-hour period there are no costs involved for rescheduling a coaching session. However, if the Client requests to reschedule a session at least 24 hours before the start of the coaching session or if the Client doesn’t show up during the session, we will charge 50% of the agreed rate of that session. 

Please note that this refund policy applies solely to coaching services provided by Your Next Chapter and may differ from other products or services offered by our business. If you have any questions or concerns regarding this policy, please contact us directly for further clarification.

B) Refunds of programs and other services. 

The Client may cancel an order within 24 hours of purchasing and request a refund. The refund will be issued, minus a 10% transaction fee. To cancel an order, send your request to anouk@yournextchapter.nl.
The Client must clearly state their decision to cancel, and the reason for said cancellation.
Reimbursement for refunds will be provided by the best available method, based on the Client’s situation and at the discretion of Your Next Chapter. A 10% transaction fee of the refund amount will apply and be subtracted from all refunds. 

If the Client cancels after the start of the program and/or receiving services with Your Next Chapter, they may only request a refund for the amount pertaining to remaining sessions or hours not yet logged. There is a three weeks notice period. The Client will not have the right to cancel or request a refund after the services have been fully performed (after all sessions or services have been completed). A 10% transaction fee of the refund amount will apply and be subtracted from the refund.

4) Procedure

The time of the coaching meetings and/or location will be determined by Coach and Client based on a mutually agreed upon time. The Client will join all scheduled calls via Zoom (or any another preferred tool) or be present in the agreed place on time. The Client will call the Coach at the following number for all scheduled meetings +31 6 31245022 in case the Coach has not shown up yet after ten minutes. If the Coach will be at any other number for a scheduled call, Client will be notified prior to the scheduled appointment time.

5) Confidentiality

This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by the principles of confidentiality set forth in the ICF Code of Ethics. However, please be aware that the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. The Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent. 

Confidential Information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s confidential information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (g) involves illegal activity. The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.

6) Release of Information 

The Coach engages in training and continuing education pursuing and/or maintaining ICF (International Coach Federation) Credentials. That process requires the names and contact information of all Clients for possible verification by ICF. By signing this agreement, you agree to have only your name, contact information and start and end dates of coaching shared with ICF staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship, no personal notes will be shared.

According to the ethics of our profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and for coach professional development and/or consultation purposes.

7) Cancellation Policy

Client agrees that it is the Client's responsibility to notify the Coach 24 hours in advance of the scheduled calls/meetings. Coach reserves the right to bill Client for a missed meeting, as stated in 3) schedule and fees. Coach will attempt in good faith to reschedule the missed meeting.

8) Record Retention Policy 

The Client acknowledges that the Coach has disclosed his/her record retention policy with respect to documents, information and data acquired or shared during the term of the Coach-Client relationship. Such records will be maintained by the Coach in a format of the Coach’s choice (print or digital/electronic) for a period of not less than two years.

9) Termination

Either the Client or the Coach may terminate this Agreement at any time with three weeks written notice. Client agrees to compensate the Coach for all coaching services rendered through and including the effective date of termination of the coaching relationship.

10) Limited Liability 

The Client acknowledges that coaching is voluntary and takes full responsibility for their decisions and actions. The Coach does not guarantee specific outcomes and coaching is not a substitute for professional advice. Both the Coach and Client agree to maintain strict confidentiality, except when required by law or if harm is imminent.
Except as expressly provided in this Agreement, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date. 

11) Entire Agreement

This document reflects the entire agreement between the Coach and the Client, and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered or supplemented except in writing signed by both the Coach and the Client.

12) Dispute Resolution

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to 30 days after notice given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.

13) Severability

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

14) Waiver

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.

15) Applicable Law

This Agreement shall be governed and construed in accordance with the laws of The Netherlands, without giving effect to any conflicts of laws provisions.

16) Binding Effect

This Agreement shall be binding upon the parties hereto and their respective successors and permissible assigns.
By engaging in coaching services provided by Your Next Chapter, the client acknowledges and accepts the following:

Terms & Conditions - other Services

Article 1. Terms

1.1 Terms and conditions: these by Your Next Chapter handled terms and conditions, that are published on the website of Your Next Chapter.

1.2 Workshop: a workshop organised by Your Next Chapter.

1.3 Participant: the person that is going to participate or participates in a by Your Next Chapter organised coaching session, online coaching, e-course, workshop, InCompany Training or other Workshops/Training Courses.

1.4 Client: the organisation or person that is going to participate or participates in a by Your Next Chapter organised coaching session, online coaching, e-course, workshop, InCompany Training or other Services.

1.5 Interested: a person that subscribed for a newsletter via the website of Your Next Chapter or a person that has sent an email (directly or via a form on the website) to anouk@yournextchapter.nl for gaining information.

1.6 Assignment or Program: an assignment or Program organised by Your Next Chapter that does not include a Coaching session, online coaching, e-course, workshop, InCompany Training. For example a customised request from a client.

1.7 Coaching session: a coaching session organised by Your Next Chapter where sometimes coaching is combined with yoga, photography or other movement.

1.8 Website: the website of Your Next Chapter: https://yournextchapter.nl

1.9 Online coaching session: an online coaching session organised by Your Next Chapter where an online video call is set up (for example the video conference tool Zoom or Skype or your preferred tool).

2.0 Your Next Chapter: is established in Amsterdam at the Bernhard Eilershof 5 (1087DC) and is registered in the Chamber of Commerce with the number 69060363.

 

Article 2. The agreement

2.1 The agreement is valid at the moment a person subscribes via email, via the website or via a payment for a Workshop, Coaching session, Training Course or other Services. Also signing an quote or agreement results into a valid agreement.

2.2 Placement is based on the order of bookings coming in and on condition that payment is completed in time.

2.3 Participation in yoga, meditation, breathing exercises in some of the workshops and training courses is only allowed when it is not harmful for your health. In case of medical, physical and/or psychological symptoms or issues you are responsible for informing the coach or trainer (in this case Anouk Bleijenberg). Negligence is the responsibility of the client or participant itself.

 

Article 3. Liability

3.1 Your Next Chapter is obligated to perform the Assignment, Workshop and Coaching session according to insight and capability.

3.2 Your Next Chapter cannot be held liable for the belongings of the Participant and/or Client.

3.3 Your Next Chapter cannot be held liable for physical and/or mental injury, loss or damage - regardless of the cause - that the Participant/Client may suffer as a result from or during participation in the Assignment, Workshop, Coaching session or other Services provided by Your Next Chapter.

3.4 Participants during any physical Assignment, Workshop, Coaching session or other Services are obliged to inform the trainer or teacher about any injuries, pregnancy or any other physical or psychological inconveniences. Without knowledge about this the teacher or coach is not able to guide the Participant or Client thoroughly.

3.5 Participants with a low or high blood pressure and/or heart disorders are advised not to participate in a physical Assignment, Workshop, Coaching session or other Services organised by Your Next Chapter. A Participant with above described symptoms is responsible for setting their limits and act on this.

3.6 Your Next Chapter works with qualified teachers and coaches. Nevertheless there is a chance on injuries during a Assignment, Workshop, Coaching session or other Services organised by Your Next Chapter. Your Next Chapter is advising the following in order to limit the risk on an injury:

  • Always inform the teacher, coach or trainer about your injuries or any other physical inconveniences prior to the Assignment, Workshop or Coaching session.

  • Consult a doctor in case of doubt about health or pregnancy.

  • Listen carefully to the instructions of the teacher, trainer or coach and act on it.

  • Listen carefully to the signals your body is sharing with you and act on it.

  • Perform exercises carefully and take into account your physical limitations.

  • Do not perform any exercise that causes pain.

  • Always consult the teacher in case you are uncertain about a certain exercise.

Article 4. Applicability and disputes

4.1 The Terms and Conditions are applicable to all - with the exception of terms and conditions from third parties - Assignments, Workshops, Coaching session or other Services organised by Your Next Chapter. By participating in an Assignment, Workshop or Coaching session the Participant and/or Client confirms the agreement with the applicability of these terms and conditions.

4.2 Deviations from this agreement are only legally binding in case of written agreement by Your Next Chapter and the concerning Participant or Client.

4.3 Only the Dutch law applies to the Terms and Conditions of Your Next Chapter.

4.4 Your Next Chapter has the right to change these Terms and Conditions. The latest version of the Terms and Conditions is always the applicable version and is available on the Website. Your Next Chapter will inform any adjustments of the Terms and Conditions to current Participants and Clients on beforehand by email. Current Participants or Clients are those that already confirmed a future Assignment, Workshop or Coaching session.

4.5 Disputes arising from the agreements to which these Terms and Conditions apply will be submitted to the competent court in the place or environment o the establishment of Your Next Chapter subject to appeal.

Article 5. Payment

5.1A The Participant or Client (Individual or Business) must pay the amount due for an Assignment, Workshop or Coaching session within 30 or 60 days after the invoice date. In case of a different agreement in the agreement or quote, the agreement or quote is leading.

5.1B The Participant (Private) must pay the amount due for a Coaching session within 14 days after the actual Coaching session and for Workshops and Programs the payment is due in advance of the starting date. In case of a different agreement in the agreement or quote, the agreement or quote is leading.

5.2 If the Participant or Client fails to pay the amount due within the agreed period the Participant or Client is not allowed to participate in the (or a future) Assignment, Workshop, Coaching session or other Services.

5.3A A reservation of a Workshop or Program can be cancelled or rescheduled - only by email - to another date up to two weeks in advance without any cancellation costs. Rescheduling within two weeks to the Workshop or Program there are cancellation costs involved (see “cancellation by Participant/Client”).

5.3B A reservation of a Coaching session can be cancelled or rescheduled - only by email - up to 24 hours before the coaching session without any further costs. For rescheduling or cancelling a coaching session within 24 hours prior to the planned session see “cancellation by Participant/Client”.

5.5 The applicable prices for Assignments, Workshops, Coaching session or other Services are on the website or send by email to a Participant/Client upon request. Your Next Chapter reserves the right to change the prices of the Assignments, Workshops, Coaching session or other Services. Any changes will be announced prior to the Assignment, Workshop or Coaching session on the website and/or by email.

Article 6. Exclusion

6.1 Your Next Chapter reserves the right to refuse any of the confirmed Participants/Clients to an Assignment, Workshop, Coaching session or other Services in case the Participant/Client could risk their health and/or when the Participant/Client did not meet the payment requirements in the agreed period.

 

Article 7. Cancellation

7.1 The Participant/Client reserves the right to cancel their participation in an Program or Workshop, but only by email (anouk@yournextchapter.nl). There is a possibility that extra costs are involved in the cancellation.

7.2 The Participant/Client reserves the right to cancel their participation in a Coaching session, but only by email (anouk@yournextchapter.nl). There is a possibility that extra costs are involved in the cancellation. This is normally 50% of the agreed fee.

7.3 Up to two weeks prior to the Workshop or Program the Participant/Client has the right to cancel or reschedule to a new date without any further costs.

7.4 Up to 24 hours prior to the Coaching session a Participant has the right to cancel or reschedule to a new date without any further costs.

7.5 In case of cancellation by the Participant/Client within 14 days prior to the date of the Program or Workshop Your Next Chapter cannot grant a refund. The amount cannot be deducted from other workshops.

7.6 In case of cancellation by the Participant/Client within 24 hours prior to the date of the Coaching session Your Next Chapter cannot grant a refund. The amount cannot be deducted from other workshops.

7.7 Your Next Chapter reserves the right to cancel any Assignment, Workshop or Coaching session without a given reason. Any changes are, as far as possible, announced in advance on the website and/or by email.

7.8 The Participant/Client will receive a full refund in the event of cancellation by Your Next Chapter. However, by rescheduling by Your Next Chapter there will be no refund.

 

Artikel 8. House rules (during Workshops, Training courses, Coaching sessies and other Assignments on location)

8.1 Participants must at all times conform to below subscribed house rules of Your Next Chapter:

  • Out of respect to the other Participants we kindly ask you to be present at least five minutes before the start of the Program or Workshop.

  • Join the Workshop or Program fresh and preferably do not use any perfume or other fragrances.

  • Wear clean and comfortable clothing.

  • Only enter a yoga studio without shoes.

  • It is not wise to participate in a Workshop with a full stomach.

  • The location of the Workshop provides yoga mats for during the class. Afterwards the yoga mats must always be cleaned and returned to the location.

  • Sexual behaviour or anything near Sexual behaviour is not tolerated by Your Next Chapter. The (physical) integrity of Trainers and Participants must always be respected.

8.2 Your Next Chapter reserves the right to refuse Participants/Clients in case of breaking any of above mentioned house rules. The Participant/Client could be refused by future Assignments, Workshops and Coaching sessions and no refund will be made.
